These terms govern your use of this website. By using it, you agree to them.

1. Agreement

These Terms of Use govern your access to and use of SmartFinClub at https://www.smartfinclub.com, including all calculators, content, reports and forms. By accessing or using the site you agree to be bound by these terms and by our Privacy Policy and Financial Disclaimer, which form part of these terms. If you do not agree, do not use the site.

2. Eligibility

This site is intended for use by adults in the United States. The tax, lending and investment information published here reflects United States federal rules and is unlikely to be relevant elsewhere. If you are under 18, please do not submit personal information through any form on this site.

3. Not advice

Everything on this site is educational information and estimates. It is not financial, investment, tax, legal or accounting advice, and no advisory or fiduciary relationship is created by your use of it. The Financial Disclaimer sets this out in full and applies to your use of every part of this site — the calculators, the reports they generate, and the articles published on the FinTalks blog alike.

Some calculators on this site deal with subjects where the rules are set by a contract or by a third party rather than by us — rental property underwriting, private mortgage insurance cancellation, the tax on selling a home, and self-employed retirement plan limits among them. What the site publishes about these is a description of the general position. Your lender, servicer, settlement agent, plan administrator or tax adviser governs your particular case, and you should confirm anything you intend to act on with them.

4. Permitted use

You may use this site for your own personal, non-commercial purposes, and you may download and share reports the site generates for you. You may link to any page.

You may not:

  • Copy, republish or redistribute substantial portions of the site's content without permission
  • Scrape, crawl or harvest the site by automated means at a rate that burdens the service
  • Attempt to gain unauthorised access to any part of the site, its servers or its data
  • Interfere with the site's operation, security or availability, or introduce malicious code
  • Reverse engineer the site to create a competing service
  • Use the site or its forms for unlawful, fraudulent, abusive or deceptive purposes
  • Submit information you are not authorised to submit, or that infringes anyone's rights
  • Misrepresent the site's output as professional advice, or present it as such to others

5. Registration

Registration on this site is optional and unlocks downloadable PDF reports. It is not a financial account: no password is created, no authentication is performed, and no financial data is stored. It is a record of a name, email address and phone number, together with your consent to be contacted.

You agree that any information you provide is accurate and that you are entitled to provide it. We may decline or remove any registration at our discretion.

6. Consultation services

Where SmartFinClub offers a paid consultation, the following apply:

  • A consultation is an educational discussion. It is not regulated investment advice, tax preparation, accounting or legal services, and does not create a fiduciary or professional relationship.
  • Scope, fees and payment terms will be confirmed in writing before any consultation takes place and before any payment is taken. Submitting a request does not create a binding engagement.
  • No outcome is guaranteed. Any potential savings or benefits depend on your individual circumstances, your eligibility, applicable laws and regulations, and the strategies actually available to you.
  • Where a matter requires a licensed professional, we will say so and decline the engagement rather than proceed.
  • Any fee arrangement based on demonstrated savings will be defined in writing, including how savings are measured, over what period, what evidence is required, and what happens if savings cannot be demonstrated.

7. Documents you send us

Do not send sensitive personal or financial documents through this site unless we have specifically confirmed a secure channel for them. Where a document upload is offered, it is described together with its limitations at the point of upload. We will delete uploaded documents once they are no longer needed for the purpose you sent them.

8. Intellectual property

The content, design, code and structure of this site are owned by SmartFinClub or its licensors and are protected by copyright and other laws. Financial formulas themselves are not proprietary and we make no claim to them; the particular expression, explanation, presentation and implementation on this site are.

Articles published on the FinTalks blog are original editorial content and are covered by the same copyright as the rest of the site. You may quote a short extract with a link back to the article; republishing an article in whole, or reproducing it behind a paywall or in a training corpus, requires written permission.

Reports generated by the site from your own inputs are yours to use, keep and share.

Embedding our calculators

You may show the calculators we offer for embedding (listed at Calculators for your website) on your own website, free of charge, using the embed code we provide, on these conditions:

  • Keep the credit line supplied with the code (“… by SmartFinClub”, linked to SmartFinClub) visible, unchanged and working, and do not hide, crop or cover the SmartFinClub name shown inside the calculator.
  • Do not alter, copy, re-host or reverse-engineer the calculator, and do not present it as your own work or as advice from you or from SmartFinClub.
  • Do not place it on pages that are unlawful, deceptive, or that suggest SmartFinClub endorses, sponsors or is affiliated with you, your products or your services.

Embedded calculators are provided “as is” for education only, under these terms and our Financial Disclaimer. Embedding creates no partnership, agency or advisory relationship. We may change, move or withdraw any embeddable calculator, or stop it from displaying on a particular website, at any time and without notice.

9. Availability

The site is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, error-free, secure, or that any defect will be corrected. We may modify, suspend or discontinue any part of it at any time without notice.

10. Accuracy

We take care over the correctness of the mathematics and the currency of tax data, and we test calculations automatically. We do not warrant that the site is free of errors. If you find one, please tell us.

11. Limitation of liability

To the fullest extent permitted by applicable law, SmartFinClub, its owner and contributors shall not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages, or for any loss of profits, savings, data, goodwill or opportunity, arising from or relating to your use of this site — whether based in contract, tort, negligence, strict liability or otherwise, and whether or not we were advised of the possibility of such damages.

Where liability cannot lawfully be excluded, it is limited to the greater of the amount you paid us in the twelve months preceding the claim, or one hundred United States dollars.

12. Indemnity

You agree to indemnify and hold harmless SmartFinClub, its owner and contributors from any claim, loss or expense arising from your misuse of the site, your breach of these terms, or your violation of any law or the rights of any third party.

13. Third-party services

The site loads charting and PDF libraries from third-party content delivery networks, uses Google AdSense to display advertising and Google Analytics to measure how the site is used, and may in future use additional third-party form processing or analytics services. The Today’s Rates section on the homepage displays data from Freddie Mac and the U.S. Treasury, obtained through the Federal Reserve Bank of St. Louis FRED® API, and exchange rates from the Frankfurter API; our server fetches that data, and no information about you is sent to those providers. Those services have their own terms and privacy policies. Any such services actually in use are disclosed in our Privacy Policy.

14. Changes to these terms

We may update these terms. The current version is always published here with its date. Continuing to use the site after a change constitutes acceptance of the updated terms.

15. Governing law

These terms are governed by the laws of the Commonwealth of Virginia and applicable United States federal law, without regard to conflict of law principles. Any dispute arising from these terms or your use of the site will be brought in the state or federal courts located in Virginia.

16. Severability and entire agreement

If any provision of these terms is held unenforceable, the remainder continues in effect. These terms, together with the Privacy Policy and Financial Disclaimer, constitute the entire agreement between you and SmartFinClub regarding the site.
